Tóm tắt: Ủy ban Dân nguyện ở Cộng hoà liên bang Đức là một mô hình điển hình trên thế giới với tính chất là một ủy ban Hiến định, một ủy ban chuyên môn về dân nguyện. Sự độc đáo của mô hình này chính là ở việc tạo ra một cơ chế vừa bảo đảm quyền thỉnh nguyện của người dân, vừa giám sát thi hành pháp luật và giám sát văn bản pháp luật thống nhất, vừa giúp Hạ viện thực hiện được tốt chức năng, nhiệm vụ của mình, vừa tránh được việc mâu thuẫn, chồng chéo về chức năng, thẩm quyền với các cơ quan nhà nước khác. Trong bài viết này, tác giả tập trung phân tích, làm rõ vị trí pháp lý, thẩm quyền, quy trình hoạt động của Ủy ban dân nguyện ở Cộng hoà liên bang Đức, từ đó đưa ra một số so sánh và gợi mở ở Việt Nam.

Abstract: The Petition Committee in the Federal Republic of Germany is a typical modality in the world as a Constitutional committee, a specialized committee on civil petition. The uniqueness of this modality is that it establishes a mechanism that both ensures the people's right to petition, supervises law enforcement and supervises unified legal documents, and helps the House of Representatives to enforce the law with their functions and tasks, while it is to avoid the conflicts and overlaps in functions and authority with other state agencies. Within this article, the author provides an analysis and clarification of the legal position, authority, and operation mechanism of the Petition Committee in the Federal Republic of Germany, thereby also make comparisons and suggestions for Vietnam.
