ABSTRACT

The LGBT right to adopt is an issue, which is extremely necessary to research in the context of Vietnam. There are some controversial problems relating to the LGBT right to adopt, including: Should this right be legalized? How have their rights been limited in Vietnam? What should we do to protect this right for LGBT in Vietnam? In our opinion, these questions should be answered clearly and comprehensively, especially in the political, social, and economical contexts of Vietnam. There have been some scientific publications in Vietnam over the past few years concerning this topic. They show that LGBT persons wish to adopt children, but this right has not been legalized under Vietnamese law yet. In fact, some LGBT persons, especially same-sex couples, are still living together as a family without legal guarantees such as conditions of personality, mutual property, as well as the nurturing and taking care of children. In this paper, the authors analyze and evaluate the shortcomings of ensuring conditions for the LGBT right to adopt as well as the reasons why they exist. At the end of this paper, the authors point out some long-term and urgent solutions, as well as the ways to actualize them in the conditions of Vietnam in order to protect better the LGBT right to adopt.

ABSTRACT:

In this article, the author focuses on analyzing two main contents: The first one is an overview of the Association of Southeast Asian Nations (ASEAN). The second one is the role of Vietnam in ASEAN for the objective of legal cooperation, harmonization and unification. In the first part, the author analyzes issues such as: an overview of the history of formation and development of the Association of Southeast Asian Nations (ASEAN), the organizational structure of ASEAN, and the current principles of ASEAN. In the second part, the author clarifies the role of Vietnam in ASEAN. In this part, the author analyzes and clarifies Vietnam's integration and contribution to ASEAN. At the end of this paper, he also points out some challenges and prospects of Vietnam in this process.

Tóm tắt: Nguyên tắc pháp quyền là một trong cấu thành quan trọng của quản trị tốt. Việc thực hiện nguyên tắc này trên thực tế ở Việt Nam còn nhiều bất cập, hạn chế, cần phải xác định nguyên nhân và đưa ra giải pháp khắc phục.

Abstract: The rule of law is one of the important components of good governance. The enforcement of this principle in practice in Vietnam still faces with a number of shortcomings and constraints, and it is necessary to indentify the causes and give out recommendatiosn for further improvements.

Tóm tắt: Cuộc cách mạng công nghiệp lần thứ tư, quá trình chuyển đổi số, yêu cầu xây dựng Nhà nước pháp quyền đã và đang tác động mạnh mẽ tới mọi mặt của đời sống xã hội, trong đó có vấn đề tư duy, nhận thức trong xây dựng và phát triển án lệ. Mặc dù thời gian vừa qua, nhiều án lệ đã được công bố, nhưng việc nhận thức về án lệ, cũng như việc áp dụng án lệ trên thực tế ở nước ta còn rất nhiều bất cập. Trong phạm vi bài viết này, tác giả phân tích, làm rõ án lệ và vai trò của án lệ trên thực tếở Việt Nam; những bất cập trong thực tiễn áp dụng án lệ ở Việt Nam và đề xuất giải pháp nâng cao chất lượng, hiệu quả áp dụng án lệ ở Việt Nam.
