ENHANCING QUESTIONING MECHANISMS IN THE VIETNAMESE NATIONAL ASSEMBLY: CURRENT PRACTICES AND STRATEGIC IMPROVEMENTS

Abstract: According to current legal regulations, the Vietnamese National Assembly employs two forms of questioning: direct questioning and written questioning. This article summarizes questioning activities and the forms of questioning used in the National Assembly. It analyzes the advantages and disadvantages of each form, highlighting their practical implications. The effectiveness of both forms in real-world application is carefully evaluated. A comparative assessment is conducted to identify strengths and weaknesses. Based on the findings, the article proposes solutions to enhance the effectiveness of these questioning methods. These recommendations aim to improve the quality of parliamentary questioning in the future.

Abstract: Reasoning based on case law constitutes the most common and significant form of legal reasoning. Analogical reasoning, among other types of case law reasoning, including reasoning based on binding precedents, persuasive precedents, overruling precedents, distinguishing precedents, prevails. The paper examines, analyzes, and evaluates these types of reasoning from an international perspective, using arguments derived from specific cases. It also offers suggestions for applying and developing this method, particularly in the context of legal reasoning in case law in Vietnam today.

Abstract: The Draft Law on Teachers is a significant step toward protecting teachers' rights and improving their quality. This article analyzes five key issues: overlap with existing laws, lack of transparent supervision, insufficient emphasis on practical competencies, inadequate legal protection for teachers, and inflexible policies for educators in remote areas. The author proposes clarifying the law's distinct features, strengthening enforcement mechanisms, and implementing practical support and flexible policies. These solutions ensure feasibility and enhance teachers' status, aligning with the goal of sustainable educational development.
